The matter has been taken up through video conferencing.
The petitioner seeks bail in Rafiganj P.S. case No. 266/ 2019 registered under Section 504, 506, 34 of the Indian Penal Code and u/s 27 of the Arms Act.
The informant alleged that Lalbabu, Bhim Singh, Antu Pandey and Vikash Sharma, the petitioner, came to his house and began to abuse. When the informant asked the reason for abusing, Lalbabu is said to have disclosed that his son-in-law used to demand money. The informant replied that his son-inlaw was not in the house. On such, the accused persons went away by firing in the air.
The learned counsel for the petitioner submits that no
Patna High Court CR. MISC. No.16309 of 2020(2) dt.02-06-2020 2/2 specific allegation of firing is made against the petitioner. The firing was not made pointing at the informant. The petitioner is in custody since 22.01.2020.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. case No. 266/ 2019.
