Petitioner, already in custody, seeks bail in connection with Turkauliya P.S. Case No.243 of 2017, registered under Sections 376 and 511 of the Indian Penal Code as well as under Sections 8, 12 and 18 of the POCSO Act.

Allegation in brief is that the petitioner, a school teacher, after closing the room and undressing the daughter of the informant made an attempt of rape.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case, charge-sheet has been submitted and he is in custody since 08.05.2017. Having considered the nature of the offence, prayer of

Patna High Court Cr.Misc. No.60935 of 2017 (2) dt.19-12-2017 2 /2 bail of the petitioner is refused in connection with Turkauliya P.S. Case No.243 of 2017, pending in the court of 1st Additional Sessions Judge-cum-Special Judge (POCSO Act), East Champaran at Motihari.

However, the trial court is directed to expedite the trial and preferably conclude the same within a year. Let a copy of this order be also sent to the Superintendent of Police, East Champaran to take all necessary steps to produce the prosecution witnesses before the trial court. (Arun Kumar, J.)
