Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Nathnagar P.S. Case No. 741 of 2022 registered for the offence under Section 392 of the Indian Penal Code and subsequently Section 412 of the IPC was added.

The prosecution story in short is that on 22.09.2022 at about 10PM, the informant was going to Mirzapur after taking wheat "chakki" parts near Noorpur. At about 10:20PM,

Patna High Court CR. MISC. No.20586 of 2023(2) dt.22-05-2023 2/3 near Kanjhia Chowk near Bajrang Bali Temple, four miscreants came on two motorcycle and they overtook the pick-up van of the informant and they looted the mobile phone of the informant.

Learned counsel for the petitioner submits that the petitioner is in custody since 22.09.2022 and there is no recovery of any incriminating article from the possession of the petitioner.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Bhagalpur/concerned Court below in connection with Nathnagar(Madhusudanpur) P.S. Case No. 741 of 2022.

The petitioner will visit Madhusudanpur, DistBhagalpur Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in
