2. Petitioner apprehends arrest in a case registered for the offence punishable under section 109 and 3(5) of the BNS and 27 of Arms Act.

3 . As per the prosecution case , on 01.11.2024 at about 4:20 AM, while informant went on morning walk and when he reached near Bagicha , in the meantime , all the accused persons along with this petitioner came there and this petitioner fired upon neck of informant due to which he sustained fire arm injury .

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case . No incriminating article has been recovered from the

Patna High Court CR. MISC. No.20661 of 2025(3) dt.28-07-2025 2/2 conscious possession of this petitioner.

5 . Learned counsel for the State opposes the prayer for bail and submits that there is specific allegation against this petitioner that he opened fire upon informant due to which informant sustained fire arm injury .

6. Considering the material available on record and the fact that petitioner is alleged to have caused firearms injury to the informant, prayer for pre-arrest bail of the petitioner is rejected.
