ANJANA MISHRA ORAL ORDER 05-09-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has been in custody since 22.01.2018 in connection with Harsidhi P.S. Case No. 19/18 registered for the offences punishable under Sections 489(B), 489(C)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected vide order dated 27.04.2018 passed in Cr. Misc. No. 18513 of 2018 with liberty to the petitioner to renew his prayer for bail after framing of charge. He further submits that in view of Annexure-3, the charge has already been framed and the petitioner is willing and ready to co-operate with the trial and may be extended the
Patna High Court Cr.Misc. No.54381 of 2018 (2) dt.05-09-2018 2/3 privilege of bail.
Considering the aforementioned facts and circumstances and taking into consideration the period of custody and also the fact that the petitioner is having a clean antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge cum Special Judge, Motihari, East Champaran, in connection with Harsidhi P.S. Case No. 19/18, subject to the following conditions:-
(1) Father of the petitioner will be the bailor.
(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State
