The petitioner is in custody in connection with Ghosi P.S.Case No.29 of 2014 registered for an offence under Section 366(A)/34 of the IPC. The allegation is that this petitioner abducted his minor daughter on 07.12.2014.

Learned counsel for the petitioner submits that the daughter of the informant is major. She had love affairs with this petitioner and she voluntarily left her house and married with this petitioner and from the said wed-lock, she has been blessed with two sons. The victim was produced before the Magistrate where her

Patna High Court Cr.Misc. No.60730 of 2017 (2) dt.20-12-2017 2/2 statement under Section 164 of the Cr.P.C. was recorded. She disclosed her age as 22 years. However, the Magistrate recording her statement has assessed her age as 21 years and on calculation, she appears to be major on the date of the occurrence. Petitioner is in custody since 04.10.2017.

The learned APP opposed the submissions.

Considering the facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Jehanabad in connection with Ghosi P.S.Case No.29 of 2014.
