2. The petitioner seeks regular bail in connection with PR Case No. 52 of 2021-22, Reg. No. 238 of 2022, for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. Learned counsel appearing on behalf of the petitioner submitted that the petitioner was granted provisional bail vide order dated 15.06.2022 and till date he has not misused the condition on which the petitioner has been released. He further submitted that the petitioner has remained in custody since 13.12.2021 and similarly situated other co-accused have already been released on regular bail.

4. However, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
5. Considering the submission made on behalf of the rival parties as well as the fact that no substantial progress has taken place in conduct of the trial, the provisional bail granted to the petitioner vide order dated 15.06.2022 is made absolute on similar terms and conditions.
