2. The petitioners has preferred this application for grant of regular bail in a case in connection with Supaul P.S. Case No. 86 of 2020 registered for the offences punishable u/s 302, 120B read with 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the co-accused persons Rajendra Mahto, Arun Rai, Sattar Miyan, Ram Prasad Yadav and Devenand Mahto are alleged to have assaulted the informant's father and also threatened to kill his whole family. On 06.02.2020, all the accused persons killed the informant's brother Manjesh Kumar after calling him under conspiracy.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. and the name of the petitioner has sprung up in the confessional statement of the co-accused, Suman Kumar Singh and Rishu Singh. It is further submitted that there is no eye-witness to the alleged occurrence. There is nothing against the petitioner except the confessional statement of the co-accused. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 15.06.2020. The co-accused person has already been granted regular bail by this Court vide order dated 25.08.2022 passed in Cr. Misc. No. 16002 of 2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of this case as well as the period of custody, the petitioner is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-V, Supaul in connection with Supaul P.S. Case No. 86 of 2020, with a condition:- (i) The petitioner is directed to remain physically
