JUSTICE RAKESH KUMAR ORAL ORDER 18-04-2018 Heard Sri Rana Ishwar Chandra, learned counsel for the petitioner and learned A.C. to A.A.G. No. 15. The present petition was filed for initiating contempt proceeding against opposite parties on an allegation of willful disobedience to an order dated: 05.02.2016 passed in C.W.J.C. No. 19932 of 2014.

In this case, number of show-causes have been filed and it has already been indicated that almost all the retiral dues of the petitioner have already been paid. So far commutation

Patna High Court MJC No.3509 of 2016(12) dt.18-04-2018 2/2 of pension is concerned, a plea has been taken that petitioner had not applied for commutation of pension and this was the reason that no sanction order in respect of commutation of pension was passed. In this case show-cause on behalf of Accountant General, Bihar has already been filed in which it has been reiterated that some formalities were required to be fulfilled by the petitioner only then any step can be taken for settling the dispute. In this case further supplementary showcause has been filed on behalf of opposite party no. 6 on 10.04.2018 wherein it has been indicated that petitioner has not given any option for commutation of pension in the pension form and for that very purpose some formalities are required to be done by the petitioner himself only then any step can be taken.

Considering the fact that order of the writ court has already been substantially complied , there is no reason to keep the matter pending.

The petition stands disposed of.
