The petitioner seeks bail in connection with Kotwali (Barari) P.S. Case no. 637 of 2016 registered for the offence punishable under Sections 395 of the Indian Penal Code. 10-12 unknown miscreants are said to have looted 24 batteries from the premises of Bihar State Road Transport Corporation, Bhagalpur in the night on the point of pistol by making the security guard hostage.

It is submitted by the learned counsel for the petitioner that the petitioner is neither named in the FIR nor any incriminating article has been recovered from his conscious

Patna High Court Cr.Misc. No.54043 of 2017 (2) dt.15-11-2017 physical possession. There is noting in the record indicating complicity of the petitioner in the occurrence barring confessional statement of co-accused Deepak Das and said Deepak Das has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 26.04.2017 passed in Cr. Misc. no. 15833 of 2017. The petitioner has been languishing in custody since 28.04.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge Vth, Bhagalpur in connection with Kotwali (Barari) P.S. Case no. 637 of 2016.
