Petitioner seeks bail in Khaira P.S. Case No.99 of 2018 instituted for the offence under Section(s) 363, 366-A/34 Indian Penal Code.

Counsel for the petitioner submits that victim girl has given statement under Section 164 Cr.P.C., wherein, she has stated that she was in love with Shankar Kumar. She had voluntarily gone to Ludhiana with Shankar Kumar. She has not levelled any allegation against this petitioner. It is further submitted that Shankar Kumar has already been granted bail by co-ordinate Bench of this Court by order dated 09.07.2018 passed in Cr. Misc. No.38160 of 2018.

Patna High Court Cr.Misc. No.49059 of 2018 (2) dt.25-09-2018 2/2 Petitioner is said to be in custody since 16.03.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui, in connection with Khaira P.S. Case No.99 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
