JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Didarganj P.S. Case No. 236 of 2018, registered for the offences punishable under Sections 30(a) and 38(i) of Bihar Prohibition and Excise Act.
Allegation is of recovery of 900 litres of foreign liquor from the pickup van and the driver of the van was arrested at the spot, who disclosed the name of the petitioner as supplier of the liquor and asked him to unload the same at Mithapur Bus Stand and for that he promised to pay him Rs.10,000/-.
Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him and he has no criminal antecedent.

Having heard both sides and in the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
With the above observation, this application is disposed of.
