1. At the outset, the learned counsel for the respondent-State submits that the Circle Officer, Dhaka, District-East Champaran at Motihari, i.e. the respondent no.3 has already initiated encroachment proceedings against the encroachers, vide Encroachment Case No. 5 of 2022-23.

2. At this juncture, the learned counsel for the petitioner seeks a direction upon the respondent no.3 to expeditiously dispose off the aforesaid Encroachment Case No.5 of 2022-23.

3. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the Circle Officer, Dhaka, District-East Champaran at Motihari, to conclude the

Patna High Court CWJC No.5999 of 2020(3) dt.17-10-2024 2/2 proceedings of the aforesaid Encroachment Case No.5 of 202223, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law and after hearing the affected parties, within a period of six weeks of receipt/production of a copy of this order

4. The writ petition stands disposed off on the aforesaid terms.
