This application is for grant of regular bail in connection with Madhepura (Ghailadh) P.S.Case No.184/17 for the offences punishable under Sections 341, 323, 379, 326, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioner is of causing injury of Dabia on the ear of the informant and the injury appears to be grievous in nature.

Submission of the learned counsel for the petitioner is that the informant and the petitioner are own brother and there is land dispute between the parties and the proceeding under Section 144 is going on. In this case the petitioner has been falsely implicated. He is in custody for three months. Heard learned A.P.P. also.

No.53216 of 2017 (3) dt.22-11-2017 2/2 Having heard both sides and in view of facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, considering the fact and circumstances the learned trial court is directed that once the charge is framed in this case, he will release the petitioner on bail to his own satisfaction on the undertaking filed by the petitioner that he will co-operate in disposal of the trial and will appear on each and every date except showing any genuine reason. With the aforesaid observation, this application is dismissed.
