This is an application for bail in connection with Town P.S. Case No. 393 of 2017, corresponding to G.R.No. 2727 of 2017, registered for the offences punishable under Sections 414 of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act. Allegation against the petitioner is of recovery of loaded country made pistol and stolen motorcycle from his possession and he has criminal antecedents also.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody for more than five months.
Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.62728 of 2017 (2) dt.11-01-2018 2/2 circumstances of the case, I am not inclined to grant bail to the petitioner.
However, learned trial court is directed to expedite the trial and try to conclude it within a period of six months. If trial is not concluded within the said period, trial court shall release the petitioner on bail to its own satisfaction. Needless to say that petitioner will co-operate in disposal of trial. With the above observation, this application is disposed of.
