Learned counsel for the petitioners seeks permission to withdraw the application with regard to petitioner No. 1 Ekbal Ali since he has been arrested.
Permission is accorded.
Accordingly the application with regard to petitioner No. 1 is permitted to be withdrawn. Petitioner Nos. 2 to 5 being brother, mother, sister and brother's wife of the husband of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 307, 323, 341, 498A, 34 of the Indian Penal Code.
The accusation is of inflicting torture and
Patna High Court Cr.Misc. No.33142 of 2015 (2) dt.28-07-2015 2/2 making an attempt to cause burn injury by pouring kerosene oil.
It is submitted by learned counsel for the petitioners that injury report as contained in Annexure-4 reflects only complaint of body pain and no injury was found by the doctor.
Considering the accusation being omnibus and general and the thrust of accusation against the husband of the informant, let the petitioners, above named, except petitioner No. 1, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Mahila P.S. Case No. 20 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
