Mr. Sri Sunil Kumar Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-09-2018 Heard leaned counsel for the petitioners and the leaned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Jadiya P.S. Case No. 03 of 2017, registered under Sections 392 and 411 of the Indian Penal Code, pending in the court of the Addl. Chief Judicial Magistrate-V, Supaul. The accusation is that on 07.01.2017 at about 5.45 P.M., while informant was returning to his house boarding on his TVS motorcycle, in the way, four miscreants boarding on two motorcycles chased him and on the point of arms robbed motorcycle, mobile, some important documents and cash of Rs. 16000/- from the informant.

Learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.49985 of 2018(2) dt.20-09-2018 2/2 petitioners are not named in the F.I.R. In course of investigation, the Police got recorded the confessional statements of co-accused Manilal Sardar and Ramesh Yadav, who confessed their guilt disclosing the names of the petitioners being their associates. Further submission is that petitioner No.1 is accused in Kumarkhand P.S. Case No. 115 of 2015, registered under Section 392 of I.P.C. and petitioner No.2 has no criminal antecedent.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
