The petitioner has prayed for regular bail in connection with Garhpura P.S. case No. 103 of 2022 for the offence punishable under Sections 394 and 397 of the Indian Penal Code.

As per prosecution case, the allegation against four unknown miscreants is that on the pistol point they looted motorcycle bearing Reg. No. BR09AL-0634 and other articles from the informant and fled away by motorcycle and scooty.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He is

Patna High Court CR. MISC. No.18683 of 2023(5) dt.24-08-2023 2/2 not named in the FIR. He has falsely been implicated in this case. It is further submitted that the petitioner is languishing in judicial custody since 11.10.2022.

Learned APP appearing for the state has vehemently opposed the prayer of regular bail and submitted that the petitioner has got two criminal antecedents and looted motorcycle was recovered from his possession. During course of investigation, he confessed his guilt before the police.

Having heard the learned counsel for the parties and considering the fact and gravity of the nature, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.

The trial Court is directed to expedite the trial and conclude the same as soon as possible.
