JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 01-07-2015 After the High Court gave a direction in terms of annexure-2, a speaking order contained in annxure-3 in relation to the petitioner as well has been passed. The speaking order deals with each and every petitioner, his background with regard to the education and the post on which the appointment came to be made.
Coming down to the case of the present petitioner, there is a clear statement and finding that the petitioner was B.Sc. (Hons.) with Math and he was appointed as an un-trained teacher in Math.
By no stretch of interpretation can a math teacher be treated as Science teacher merely with the object of giving him
Patna High Court CWJC No.5401 of 2015 (4) dt.01-07-2015 the benefit which is not otherwise available to such class of people. The analogy which the petitioner wants to draw that he had other subjects also like Physics and Chemistry while doing his graduation is of no avail because his appointment is as a math teacher and not a science teacher. In the honour's degree of the petitioner, the major subject was Math and other subjects were only ancillary.
In the circumstances, the impugned order contained in annexure-3 does not require any interference. This writ application is dismissed.
