The petitioner seeks bail in connection with Barachatti P.S. Case No. 176 of 2009 dated 23.06.2009 instituted for the offences under Sections 147, 148, 342, 379, 427 of the Indian Penal Code, Sectio 3/4 of the Explosive Substances Act as well as Section 17 of the Criminal Law Amendment Act. The petitioner is not named in the F.I.R and his name transpired only during the course of investigation through the mouth of some of the witnesses.

Learned counsel for the petitioner has submitted that there is no specific allegation against the petitioner and that many persons have been made accused in this case who are alleged to have indulged in extremist activities and some of them

Patna High Court Cr.Misc. No.53760 of 2017 (3) dt.29-11-2017 2/2 have already been released on bail by the orders of different Benches of this Court.

The petitioner is in custody since 22.08.2016. Regard being had to the aforesaid facts, this Court is inclined to grant bail to him.

The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati at Gaya in connection with Barachatti P.S.
