1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Chanpatiya P.S. Case No.166 of 2025 instituted under Sections 191(2), 191(3), 190, 115(2), 118(1), 126(2), 117(2), 109(1), 308(4) & 111 of the B.N.S., 2023.

3. As per the prosecution case, the informant had alleged that when he was storing bricks, iron rod and sand on his land, in the meantime all the accused persons including the petitioner alongwith 15 to 20 unknonwn persons came there and started abusing him. On protest, co-accused Ramesh Paswan gave a sword blow causing injury on the head of informant. Specific allegation against the petitioner is that he gave sword blow causing injury on the head of Nitish Kumar. It is also

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to land dispute. He further submits that the land of coaccused Ramesh Paswan is adjacent to the land of informant and he tried to encroach the land of co-accused Ramesh Paswan which was strogly protested and with the ulterior motive, this case has been filed. Learned counsel submits that the allegation against the petitioner is that he had assaulted with sword on the head of Nitish Kumar causing head injury to him but till date, there is no injury report with the case diary of injured Nitish Kumar which shows that the allegation has no substance. He further submits that the allegation against the co-accused Ramesh Paswan is that he gave sword blow on the head of informant but the injury report of informant shows that the injury is simple in nature caused by hard and blunt substance which falsify the prosecution case. Learned counsel submits that petitioner has got clean antecedent and he undertakes to cooperate in the investigation and trial of the case.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case, submissions of learned counsel for the parties and the nature of allegation leveled against the petitioner as well as his clean antecedent, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned J.M. 1st Class, Bettiah, West Champaran/ concerned Court in connection with Chanpatiya P.S. Case No.166 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
