JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Kotwali (University) P.S. Case No. 736 of 2013 registered under Sections-435, 436, 307, 427, 33, 337 & other minor sections of the Indian Penal Code and 3/4 of Dowry Prohibition Act. The petitioner is named in the first information report but no specific overt act has been attributed against the petitioner. The contention on behalf of the petitioner is that the petitioner is a teacher and having similar allegation, co-accused, Jitendra Kumar has already been granted privilege of anticipatory bail by a bench of this court vide order dated 15-01-2015 passed in

Patna High Court Cr.Misc. No.34581 of 2014 (2) dt.19-02-2015 2/2 Cr. Misc. No. 29756 of 2014.

Taking into consideration the above-said facts and circumstances as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner named-above, in the event of arrest or surrender in the court below within four weeks from today, shall be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kotwali (University) P.S. Case No. 736 of 2013 to the satisfaction of Chief Judicial Magistrate, Bhagalpur subject to conditions as laid down u/S 438(2) of the Cr. P.C.
