2. The petitioner seeks regular bail in connection with Alipur P.S. Case No.45 of 2023, lodged on 10.04.2023, under Section 393 of the Indian Penal Code and under Section 37 of the Bihar Prohibition and Excise (Amendment) Act, 2022.
3. Learned counsel for the petitioner submits that earlier the regular bail application of the petitioner was rejected vide order dated 17.10.2023 passed in Cr. Misc. No.67359 of 2023. Learned counsel for the petitioner submits that at the time of rejection of bail application liberty was granted to him to renew his prayer for bail after framing of the charge. Counsel submits that vide Annexure-3 of the present application, he has attached charge memo, according to which charge has been

4. Learned counsel for the State opposes the prayer for bail and submits that antecedent of the petitioner is not clean and that aspect may be taken into consideration.

In the present facts and circumstances of this case and the submissions made above, let the petitioner, above named, be granted bail on being satisfied that petitioner is not absconding in the following cases, i.e., (i) Alipur P.S. Case No.53 of 2021, (ii) Alipur P.S. Case No.54 of 2021 and (iii) Alipur P.S. Case No.45 of 2021, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum-Exclusive Special Excise Judge, Court No.2, Gaya, in connection with Alipur P.S. Case No.45 of 2023, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
