The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 30(a), 32(i), 32(3), 41(1), 41(2) of the Bihar Prohibition of Excise Act, 2018 which belongs to the petitioner.

It is a case of recovery of about 780 liters of country made liquor from a pick up van bearing registration No.BR31G-8902 which belongs to the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner is a lady and she has clean antecedent.

Patna High Court CR. MISC. No.18813 of 2022(2) dt.12-08-2022 2/2 Learned APP appearing for the State opposed the anticipatory bail.

After considering the aforesaid facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected.

However, the petitioner is directed to surrender before the court below and pray for regular bail and the court below may consider her prayer for bail without being prejudiced by this order.
