2. The petitioner seeks bail in connection with Amas P.S. Case No. 377 of 2022 registered for the offence under Sections 392 of the I.P.C.
3. The petitioner is not named in the F.I.R.
and is in custody since 30.11.2024.
4. The allegation against the petitioner is to commit robbery alongwith co-accused persons and while committing so looted coal loaded truck which was in possessions of the informant. It was alleged that the value of coal was Rs. 3,22,634/-. Fair of truck which was collected i.e., Rs. 56,188/- was also in truck, which was looted by the
Patna High Court CR. MISC. No.17360 of 2025(4) dt.25-08-2025 2/3 miscreants.

Learned counsel appearing on behalf of the petitioner submitted that the name of petitioner transpired in the course of investigation on the basis of confessional statement of coaccused Shankar Yadav, in furtherance of which no incriminating material surfaced/ recovered during investigation as to connect petitioner prima-facie with present case of robbery. It is pointed out that informant refused to join TIP. While concluding the argument, it is submitted that petitioner found involved in one more criminal case where he is on bail and moreover, investigation of this case is completed, as such, there is no chance of tampering with the evidence.
6. Learned APP while opposing the prayer of bail conceded that as per letter no. 2860 of 2025 dated 23.08.2025, issued from office of Dy.SP, Sherghati, Gaya informant refused to join TIP.
7. In view of aforesaid factual submissions and by taking note of fact as save and except

No.17360 of 2025(4) dt.25-08-2025 3/3 suspicion prima-facie nothing appears incriminating against this petitioner as to connect him with present crime in question, coupled with fact that investigation already completed where petitioner remains in custody since 30.11.2024, accordingly petitioner above named, is directed to be released on bail in connection with Amas P.S. Case No. 377 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Sherghati, Gaya/concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C/ Section 480(3) of BNSS.
8. Presence of Dy.SP is dispensed with.
