It appears that the petitioner, after superannuation in the year 2013, has not received his full retiral benefits on the objection that advances taken by him have not been properly adjusted with supporting vouchers.

Patna High Court CWJC No.10026 of 2015 dt.05-01-2016 2/3 Learned counsel for the petitioner submits that the requirement to submit vouchers was made effective only from 2008 and thus for the period prior to that the petitioner having utilized the amount without keeping copies of any vouchers cannot be denied his retiral benefits for the said period. However, with regard to the period from 2008 till his superannuation, the submission is that relevant materials including vouchers were submitted in the office of the University which would indicate that the amount taken by the petitioner or given to him by way of advances, was actually utilized for official purposes.

It is further submitted that at this stage when the petitioner had deposited all those documents and the same are not being traced in the office of the University or the Colleges, it would not be practically feasible for the petitioner to come up and explain such utilization. It is further submitted that similarly situated persons have been granted benefit by the authorities by not insisting for such vouchers and supporting documents and they have been granted 'No Objection Certificate' and also paid their retiral benefits and thus, in all fairness, such benefit should also be extended to the petitioner.

Patna High Court CWJC No.10026 of 2015 dt.05-01-2016 3/3 indicate from where such fact can be verified. If at all, it is found that the records are not available, the Vice Chancellor shall also consider that the petitioner, being a senior person, having held the post of Vice Chancellor of the University at one time may be given similar benefit of not insisting for such procedure, as has been done in the case of other persons whom the petitioner shall indicate before him. The said exercise be completed within one month from the petitioner meeting the Vice Chancellor along with a copy of this order. (Ahsanuddin Amanullah, J) Anjani/- U
