2.This application for regular bail arises out of Rajapakar (Branti O.P.) P.S. Case No. 194 of 2019, disclosing offences punishable under Section 392 of the Indian Penal Code.

It is alleged in the First Information Report that three named accused persons robbed the informant of a sum of Rs. 50,000/-, his wallet containing ATM Card, Driving License and the original papers of his motorcycle. It is further alleged that when the miscreants were attempting to flee away, the informant chased him and was able to catch-hold of this petitioner. The petitioner is said to have disclosed names of other two persons, who have also been named in the FIR. The informant after

Patna High Court CR. MISC. No.16175 of 2020(2) dt.03-06-2020 2/2 apprehending the petitioner handed him over to the police. Learned counsel for the petitioner has submitted that nothing was recovered from the petitioner's possession and he has been falsely implicated with ulterior motive. He has submitted that the petitioner has no criminal antecedent and he is in custody since 15.08.2019. He has further submitted that there is no chance of the petitioner fleeing from the course of trial and that the investigation has already been completed to the extent same relates to the petitioner.

Considering the facts and circumstances as noted above and the petitioner is in custody since 15.08.2019, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XIII-cum- Sub Judge, XIV, Vaishali at Hajipur in Rajapakar ( Barati O.P.) P.S. Case No. 194 of 2019.
