JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-07-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection Patory P.S. Case No. 136 of 2015 registered under Sections-307, 379 & other minor sections of the Indian Penal Code.

Taking into consideration that the petitioner is said to have given dagger blow to the informant and one injury, said to have been caused by pointed weapon, was found on the person of the informant, I am not inclined to extend the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Patory P.S. Case No. 136 of 2015 pending in the court of Learned Chief Judicial Magistrate, Muzaffarpur stands

Patna High Court Cr.Misc. No.30330 of 2015 (2) dt.31-07-2015 2/2 rejected.

However, if petitioner surrenders within four weeks from today and seeks regular bail, the concerned court shall consider the same on its own merit without being prejudiced by this rejection order, particularly, keeping in mind that the informant has sustained simple injury and there was dispute between the parties on the point of partition.
