The petitioner seeks regular bail in Simri P.S. Case No.135 of 2017 registered for the offence under Sections 20(B)/22 of the Narcotic Drugs and Psychotropic Substance Act. Accusation is of recovery of 650 grams of ganja from the jhola hanging in the motor cycle of the petitioner. Submission of the learned counsel for the petitioner is that quantity of recovered ganja comes within purview of small quantity. He is in custody having no criminal antecedent for about three months.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be

Patna High Court Cr.Misc. No.62411 of 2017 (2) dt.11-01-2018 2/2 enlarged on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of 1st. Addl. Sessions Judge-cum-Special Judge, Darbhanga, in G.O.Case No.15 of 2017 arising out of Simri P.S.Case No.135 of 2017 subject to the conditions that (1) one of the bailors must be local person having sufficient immovable property within the jurisdiction of the concerned court. (2) The petitioner will not induce any witness or tamper with the evidence. (3) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.
