JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after one and half years of marriage for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioner that for the occurrence of 1.1.2015 the complaint was filed on 1.4.2015 which came to be registered as police case on 1.5.2015 and the accusation is omnibus and general in nature. Patna High Court Cr.Misc. No.37476 of 2015 (2) dt.16-09-2015 2/2 accused Raj Kishore Saw has been granted anticipatory bail vide Cr. Misc. No. 30801 of 2015.
Considering the aforesaid facts coupled with the fact that petitioner is lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Barh, Patna in connection with Athmalgola P.S. Case No.90 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
