JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 The petitioners are apprehending their arrest in connection with Nautan P.S. Case No. 145 of 2015 for the offences instituted under Sections 147, 148, 149, 341, 323, 324, 325, 307, 427, 452, 380 of the IPC., and 27 of the Arms Act.

Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that all the accused

Patna High Court Cr.Misc. No.29196 of 2015 (2) dt.27-07-2015 2/3 persons armed with Lathi, Farsa, fire arms came and on the order of petitioner no. 1, they damaged his house, scattered eight bags rice and the vehicle. They also took out ornaments and petitioner no. 3 opened fire. Petitioner no. 4 gave Farsa blow on the informant's head with an intention to kill him and when Dhrup Choudhary, Bunni Choudhary and Hriday Narain Choudhary came to save the informant, the accused persons also assaulted him and took away four he-goats of the informant. It is also alleged that they looted away articles worth Rs. 10,00,000/- of the informant.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is a case and counter case between the parties. It has further been submitted that the matter has been compromised between the parties as it is evident from the impugned order.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Nautan P.S. Case No. 145 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten

Patna High Court Cr.Misc. No.29196 of 2015 (2) dt.27-07-2015 3/3 Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, West Champaran, Bettiah, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
