The petitioner apprehends his arrest for the offences alleged under Sections 147, 149, 341, 323, 307 and 504 of the Indian Penal Code, registered in connection with Jhajha P.S.Case No. 331 of 2018 and subsequently Section 302 IPC was added.
As per the allegation, altogether five accused persons named in the FIR assaulted the father of the informant. When the informant protested, they also inflicted lathi blows on his head. During the course of treatment the father of the informant died.
Learned counsel for the petitioner by referring to
Patna High Court CR. MISC. No.16301 of 2020(4) dt.27-10-2021 2/2 Annexure-4, has submitted that the learned court below has granted anticipatory bail to co-accused persons Laljit Yadav, Manoj Yadav and Mukesh Yadav, respectively, having similar allegation, vide A.B.A. No. 61/2020. He has further submitted that both the parties have compromised the case. Considering the fact that other co-accused persons, having similar allegation, have been granted anticipatory bail by the court below, the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, is also directed to be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jamui in connection with Jhajha P.S.Case No.331 of 2018, subject to the conditions as laid down under Section 438(2) Cr. P.C.
