Petitioner seeks bail in Excise Case No.1103 of 2018 corresponding to P.R. Case No.46 of 2018-19 instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016, pending in the Court of the Special Judge, Excise, Kaimur at Bhabhua.

In the prosecution report, it is alleged that one truck was intercepted near Toll Plaza, Didkhili. From the said truck, 264 bottles containing 750 ml. each, 588 bottles containing 750 ml. each, 1200 bottles containing 750 ml each, 1080 bottles containing 375 ml. each, 1128 bottles containing 375 ml. each and 600 bottles containing 500 ml. each, total 288 carton sealed

Patna High Court CR. MISC. No.20556 of 2019(2) dt.03-04-2019 2/2 liquor were recovered kept in 50 sacks of onion. In each sack of onion, 45 kg. onion were also recovered and seized. Keeping in view the recovery of huge quantity of liquor, this Court is not inclined to enlarge the petitioner on bail. Prayer of the petitioner for grant of bail is rejected at this stage.

The trial Court is directed to expedite the trial and make all efforts to conclude the same as early as possible, preferably, within a period of six months from the date of receipt of a copy of this order.

Liberty is given to the petitioner to renew his prayer for bail after six months, if no substantive progress is made in the trial.
