The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Excise Act. The learned counsel for the petitioner submits that the petitioner is in custody since 23.02.2022, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 82.5 litre of liquor from the Basa of the petitioner.

The learned counsel for the petitioner submits that petitioner was not arrested from the spot and he was falsely implicated alleging that the recovery was made from his Basa and his name is alleged to have transpired based on secret

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and was not arrested from the spot, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Khagaria (Gangaur) P. S. Case No.558 of 2020. The application stands allowed.
