JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends arrest in a case registered for the offences punishable under sections 419, 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code. It is alleged that all the named accused persons in connivance with each other and by making forgery by changing page no. 3 of the sale deed which was executed by the informant and his sisters, got executed 72.5 decimals of land instead of 1 & 1⁄2 katha land and in this way, the informant and his family members were duped with the property valued at Rs.3,21,40,000/- On behalf of the petitioner it is submitted that the petitioner has no criminal antecedent. As per the allegation,
Patna High Court Cr.Misc. No.29228 of 2015 (2) dt.27-07-2015 petitioner is said to have identified the signature on the sale deed. Except the same, there is no allegation against him. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the facts aforesaid and that it is a dispute of civil nature, let the petitioner above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, be enlarged on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar (T) P.S. Case no., 138 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
