2. The petitioner seeks bail in connection with Sessions Trial No. 162 of 2022 arising out Chainpur P.S. Case No. 11 of 2022 dated 12.01.2022, instituted for the offences punishable under Sections 302/34 of the Indian Penal Code.

3. Allegation against the petitioner and co-accused, namely, Daroga Ram is of killing the informant's father on account of not giving his motorcycle to the accused persons.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the land dispute was going on between the deceased and the father of the petitioner. Further it is submitted that another co-accused, namely, Daroga Ram has

No.18893 of 2023(2) dt.17-05-2023 2/2 already been granted bail by order dated 12.09.2022 passed in Criminal Miscellaneous No. 26871 of 2022 by a Co-ordinate Bench of this Court. Lastly, it is submitted that the petitioner is in custody since 20.01.2022 having no criminal antecedent and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-X, Kaimur at Bhabua in connection with Sessions Trial No. 162 of 2022 arising out of Chainpur P.S. Case No. 11 of 2022.
