The petitioners in the present case are seeking regular bail in connection with Laxmipur P. S. Case No. 171 of 2012 registered for the offences punishable under Sections 341, 376 of the Indian Penal Code.
Learned counsel for the petitioners submits that a bare perusal of the fardbeyan of the informant would show that there are specific allegations of committing rape against one Maheshwar Yadav, Manoj Yadav and Laloo Yadav, so far as these petitioners are concerned, though they have been shown in the column of the accused but in fact, in the body of the complaint, there is no allegation at all against these petitioners.
Patna High Court Cr.Misc. No.51907 of 2018(2) dt.20-09-2018 2/2 It is further submitted that these petitioners are the neighbours and there are disputes pending between the parties. Learned APP for the State is present and has opposed the prayer of bail.
Considering the facts and circumstances of the case wherein there is no allegation of commission of rape against these petitioners and further that these petitioners have no criminal antecedents, let the petitioners Rupa Yadav and Kankai Yadav be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned F.T.C. Ist, Jaumi in S. T. No. 188 of 2018 arising out of Laxmipur P. S. Case No. 171 of 2012, subject to the condition laid down under Section 437
(3) Cr.P.C.
