JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Patepur P.S. Case No.296 of 2019 registered for the offence punishable under Sections 302, 201 and 120B of the Indian Penal Code.
The wife of the deceased is the informant. It transpires from the First Information Report that there had been certain altercation between the informant and Radha Devi (petitioner's wife). According to the prosecution's case, when the informant had narrated the occurrence to her husband (the deceased), he had gone to enquire from Radha Devi about her behavior. The deceased, it is said, did not return thereafter and his dead body was found lying on 07.11.2019. It is evident from the First Information Report that the petitioner, his wife and

There is no eyewitness to the occurrence nor there is any circumstantial evidence to justify implication of this petitioner in the case. Considering the above, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIV, Vaishali at Hajipur, in Patepur P.S. Case No. 296 of 2019.
