Petitioner apprehends his arrest in connection with Special (N.D.P.S.) Case No. 8 of 2018, arising out of Ara Town P.S.Case No. 311 of 2018 registered for the offences punishable under Section 21(B) of N.D.P.S. Act.

Allegation as per FIR is of recovery of 16 grams of Heroine from the motorcycle of the petitioner and petitioner fled away.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and in seizure list no signature was obtained from his family members. Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.48803 of 2018 (2) dt.25-08-2018 2/2 circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit.
