Petitioners seek bail in a case registered for the offences punishable under Sections 341, 323, 307, 427 and 379/34 of the Indian Penal Code.
This is a case of misuse of privilege of bail. The petitioners misused the bail at the stage when the trial was going on for prosecution evidence. The petitioners are in custody since 04.09.2017 after surrender.
Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below
Patna High Court Cr.Misc. No.61484 of 2017 (2) dt.19-12-2017 2/2 where the case is pending in connection with S.T. No. 295 of 2003 arising out of Belhar Police Station Case No. 51 of 2002, subject to the condition that the petitioners shall regularly attend the case and shall not remain absent on any date without reasonable excuse till conclusion of the trial, failing which the court below shall be at liberty to cancel the bail bond of the petitioners and conclude the trial, after taking the petitioners into custody, within three months.
