The petitioner is languishing in custody since 06.11.2018 in connection with Guraru P.S. Case No.119 of 2018 registered for the offence punishable under Section 395 of the Indian Penal Code.
The prosecution case is that on 16.03.2018, dacoity was committed in the house of the informant. The accused took away a mobile phone worth Rs.3000/- from the pocket and Rs.30,000/-, leading to registration of the FIR against unknown. It is submitted by learned counsel for the petitioner that neither there is any recovery from possession of the petitioner nor the petitioner has been put on T.I. Parade. It is further submitted that investigation has already been completed. The
Patna High Court CR. MISC. No.18404 of 2019(2) dt.01-04-2019 2/2 petitioner is accused in one other case being Konch P.S. Case No.195 of 2018.
Learned A.P.P. for the State has vehemently opposed the prayer for bail and submits that the name of the petitioner sprang up on the basis of confession.
Considering the materials available on record coupled with the fact that the petitioner has not been put on T.I. Parade, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Gaya in connection with Guraru P.S. Case No.119 of 2018.
