12-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with S.T. No. 63 of 2016 arising out of Kahalgaon P.S. Case No. 570 of 2014 registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.

Learned counsel for the petitioner submits that, in this case, name of the petitioner has transpired in the confessional statement of the co-accused. He has been remanded in this case on 09.10.2016 and since then no T.I. parade has been conducted to identify him in connection with this case. Nothing incriminating has been recovered from the possession of the petitioner. He further submits vide Annexure-

Patna High Court Cr.Misc. No.288 of 2018 (2) dt.12-01-2018 2 series, co-accused have been granted regular bail by a coordinate Bench of this court. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned 7th Additional District and Sessions Judge, Bhagalpur, in connection with S.T. No. 63 of 2016 arising out of Kahalgaon P.S. Case No. 570 of 2014, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
