Petitioner seeks bail in connection Rajgir P.S. Case no. 278 of 2020 registered for the offence punishable under section 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 21.10.2020 and charge sheet has been submitted in this case and has one criminal antecedent as mentioned in para 3 of bail petition. Learned counsel for the petitioner further submits that allegation against this petitioner is that Apache motorcycle was recovered from his possession and other motorcycle was recovered from the possession of other accused named in the FIR, further his name came on the confessional statement of Chandan Kumar. Patna High Court CR. MISC. No.29921 of 2021(2) dt.24-11-2021 2/2 the petitioner next submits that co-accused Chandan Kumar and Mukesh Kumar have been granted bail by order dated 12.7.2021 in Cr. Misc. no. 9453/2021 and order dated 27.8.2021 in Cr. Misc. no. 31814/2021.

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody and charge sheet has been submitted and co-accused persons have been granted bail, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsarif in Rajgir P.S. Case no. 278 of 2020.
