The petitioner seeks bail in anticipation of her arrest in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a woman and the informant alleges that on 02.07.2021 at 8.30 P.M. his minor daughter had gone to field to attend nature's call when eight named accused persons including the petitioner and 2-3 unidentified accused were kidnapped her.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is next submitted that victim has returned back and her statement

Patna High Court CR. MISC. No.19097 of 2022(2) dt.27-09-2022 2/2 was recorded under Section 164 of the Cr.P.C. wherein she has disclosed her age as 18 years and has not supported the prosecution case (Annexure-2).

The learned Additional Public Prosecutor opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, is directed to be released on bail on her furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bidupur P. S. Case No.324 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
