The petitioner seeks bail in connection with Kahalgaon (Rasalpur) P.S. Case No. 1343 of 2022 registered for the offence under Section 376 of the Indian Penal Code. The prosecution story in short is that Sanjula Devi has alleged that on 30.11.2022 at 1.00 AM in night, the petitioner entered the house of the informant and committed rape with her. Informant tried to release herself but the petitioner closed her mouth and petitioner has committed rape with her.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.23971 of 2023(2) dt.18-05-2023 2/2 petitioner is in custody since 02.11.2022 and the petitioner has two antecedent.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Bhagalpur in connection with Kahalgaon (Rasalpur) P.S. Case No. 1343 of 2022.
