Sri Uma Shankar Singh, learned counsel for the petitioner submits that the writ petition was filed for directing the Respondent no.4 for provisional release of the vehicle, which was seized and confiscation proceeding was pending. He submits that he has examined the counter affidavit, which suggests that confiscation order has been passed and the vehicle in question has been confiscated. Accordingly, he seeks permission to withdraw
Patna High Court CWJC No.9495 of 2015 (4) dt.23-11-2015 2/2 this writ petition, so that he may assail the order passed in the confiscation proceeding before the appropriate forum. The prayer is allowed.
The writ petition stands dismissed as withdrawn with liberty as indicated above.
