The petitioners apprehend their arrest in Panjwara P.S. Case No.50 of 2017 registered under Sections 307 and other Sections of the Indian Penal Code.
The informant alleged that the petitioners and other accused persons having armed with different weapons came and assaulted the informant Bameshwar Yadav. When his son, Mukesh Kumar and Ratan Kumar came. Suman Panjiyara, petitioner No.2 assaulted Mukesh Kumar with khanti on his head and Rajiv Panjiyara assaulted Ratan Kumar with khanti on his head.
The learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.63623 of 2017 (2) dt.11-01-2018 informant got simple injury. Mukesh and Ratan also got simple injury. Occurrence took place due to land dispute. Considering the facts aforesaid that the petitioners and the informant have got land dispute on account of which the occurrence took place but the informant and his sons got simple injury, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Panjwara P.S. Case No.50 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
