The petitioners are in custody in connection with Dagarua P.S.Case No.19 of 2016 registered for an offence under Sections 302/34 of the IPC.

It has been submitted that the petitioners are Bhaisur and Dewar of the deceased. They are residing separately from the deceased having no concern with the affairs of deceased and her husband. Petitioners are although named in the FIR but there is no specific allegation of torture or assault. The father of these petitioners having similar allegation has been allowed bail by a coordinate Bench of this Court in Cr.Misc.No.3982 of 2017. The petitioners have clean antecedent except a case which was lodged by the deceased for the offence under sections 498A and 406 of

Patna High Court Cr.Misc. No.63381 of 2017 (2) dt.15-01-2018 2/2 the IPC. In that case the petitioners are on bail. The husband of the deceased is in custody.

Considering the facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of ACJM-II, Purnea in connection with Dagarua P.S.Case No.19 of 2016.
