2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 191 ( 2 ), 126 ( 2 ), 115 ( 2 ), 118 (1) , 109 and 352 of BNS.
3 . The prosecution case in brief, is that informant namely Vinod singh alleged that all the named accused including the petitioner Mukesh singh on 13.07.2024 at about 05:00 PM assaulted and abused informant and his brothers. It is further alleged that this petitioner assaulted informant with spade .
4. It is submitted on behalf of the petitioners that both parties are co-villagers and due to land dispute for which a title suit 913 of 2023 is going on between the parties. It is further
Patna High Court CR. MISC. No.18079 of 2025(4) dt.08-07-2025 2/2 submitted that due to aforesaid land dispute , a scuffle took place in between the parties in which both sides sustained injuries. Injuries allegedly caused by this petitioner is simple in nature . Petitioner claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the nature of injury , clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned J M First Class Siwan in connection with Prachrukhi P.S. Case No. 318 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
