The petitioners, namely, Rakesh Paswan and Mangla Tanti, apprehend their arrest in a case under Sections 341, 323, 504, 354(B), 34 of the Indian Penal Code.
The informant made allegation against all the four named accused persons and 2-3 unknown persons that they dragged her with an intention to outrage her modesty. It is submitted that the case is compromised and similarly situated coaccused Baliya Paswan and Laxmi Paswan have already been enlarged on anticipatory bail by a bench of this Court vide order dated 07.08.2015 passed in Cr. Misc. No. 30420/2015. The case of the petitioners stands on the same footing.
Considering the facts aforesaid, the above named
Patna High Court Cr.Misc. No.31007 of 2015 (3) dt.07-10-2015 2/2 petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Industrial Area P.S. Case No. 35/2015, corresponding to G.R. Case No. 1418/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
